New Blog

There seems little point in having two Blogs duplicating the same information, and as I no longer have access to the bank account in order to publish Bank statements here, I have decided to stop posting on this Blog for the time being.

Meeting
On Tuesday afternoon of this week an informal meeting was held in Mi Sol Bar, the purpose was to give information to Owners about the previous Committee meeting held in the Office, and give an opportunity for Owners to ask questions, and voice their concerns to the new President and the Committee.
The meeting was well attended, the President and several Committee members were also there.
The questions and comments were varied, although much of it covered "old ground"
Some of the topics discussed were letters being sent to tenants in the flats informing them that the Community was not receiving any payments from their Landlady for water and electricity used, even though they were paying her.
Repairs to the street lights, although I had previously arranged for this work to be done, it had not so far been carried out. The contractor has been asked again to carry out this work as soon as possible.
A list of debtors to be posted in a prominent position, renewed every three months, keeping in mind the requirements of the Data Protection Laws.
Questions of security, and in particular reference to the gates at the entrance to Mi Sol. It was explained that they could not be put back into operation legally at the moment. One Owner expressed the view they were a waste of time.
Discussion about the acquisition of the N.I.E numbers required in order that Owners could register their Escrituras when these had been granted from the Mi Sol Blanket Escritura.
It was explained that at present we could not register these Escrituras with the Land Registry, and therefore not obtain a Catastral number so Suma could be paid. Until this position changes, any Escrituras passed from Mi Sol to Owners was not of any real importance.
The financial position was explained, and described as "dire" by the President, giving an explanation of amounts that need to be paid.
Being an informal gathering, no minutes were taken.

Small Correction
In the minutes of the last Committee meeting held in the Office it states the monthly amount due to the Pool contractors is Euro 2500, in fact the amount is Euro 2,000 made up of Euro 1500 monthly repayment and Euro 500 monthly charge for maintaining the pool.
Although we now have a new President, I still remain a full member of the Committee, having only relinquished the responsibilities of the Presidency. A new Governing body of President and Committee has to be elected at the next AGM in September 2009.
Mo has done a good job of keeping this Web log going for the last few months, however it is difficult to be objective as the President when writing these posts, therefore we are now reverting back to the original format, and I will be writing all the Posts in future.

DISGUSTING WASTE OF COMMUNITY MONEY
At the AGM in September this year, the other faction produced a document showing they had lodged papers with the Courts in Torrevieja, we were assured this was simply an attempt to prevent Pepe ever becoming President again.Attached is a copy of a document which proves that to be untrue. It is in fact a form of appeal to the Courts in Madrid against the judgement we received in our favour in May of this year.
Whilst there was no right of appeal against that judgement, this is a Recurso, and from what I am given to understand from our Lawyers it is an appeal against the wording of the judgement, not against the judgement itself. This is going to cost us a minimum of Euro 2000 (two thousand) to defend, and of course presumably a similar amount will have to be paid by the other faction. However we all know that money will not be paid by them personally, but from funds they are holding which rightfully belong to the Community. Therefore the Community can look forward to losing at least another Euro 4000 as a direct result of the other faction taking this action. It is quite obvious they have no regard or concern for the welfare of the Community, only for the self interest of the 4 or 5 of them that are still carrying on.
Bear in mind this action has been taken AFTER several discussions have been held and a way of resolving the dispute was AGREED. The date of presenting this document to court is clearly shown as 11th November 2008.
This is AFTER we had agreed to credit proper Cambank receipts to the accounts of those who have paid the other side.
This is AFTER we had agreed to consider other receipts of these same people, provided the Administrator acting on their behalf demonstrated by proper accounts where that money had gone. So far he has only managed to produce accounts for 2003.
This is AFTER we were told the court case was only to stop Pepe ever becoming President again, and that they were paying for it out of their own pockets.
This is AFTER we were told they had sacked their Lawyer, clearly not true as his name is on the document.
We all know that the only winners in Court cases are the Lawyers, which is why I have preferred to spend my time as President reaching agreements for people to pay in instalments rather than resort to legal action.
At the end of the day the other factions disagreement is with Pepe, not the Community which has done nothing wrong. So why should the Community have to pay for what is essentially a private war ?
It seems a member of the other side paid a very large amount of money into their Caja Rural account at the end of October, later he approached a candidate for President offering his support, and indicating his desire to become Vice President. If this was a guenuine approach, why did he not pay his money into Banco popular where it rightfully belongs ?

New President
In a few days time the Community will be called upon to elect a new President. Secretary Mrs Mo Taunton has indicated her willingness to stand. This is terrific news for the Community, I have no doubt whatsoever that if she is elected she will make an excellent President. Mo has my complete support and in the interests of the Community I would ask you all to support her also. During the last few weeks Mo has been doing all the work, due to the pressures of my job I have only been able to carry out Official duties, and even before being elected to the Committee she worked very hard for the Community.
A change of President will not mean the end of this Web Log you will continue to receive true and accurate information about what is happening on Mi Sol.

EGM Update
To date the notification of the forth coming EGM has still not been sent out by APYME. They have been asked the reason for the delay and have replied that the legal requirement for notification is 48 hours, not very helpful for the return of proxy votes!
Electricity and Water increase.
In July Iberdrola and Aguamed increased their charges by 8% and 100% respectively, APYME were instructed to put these charges onto the October bills which they failed to do, reason from Melanie...."I forgot"!!! The bad news is that both Iberdrola and Aguamed have Direct Debits and the increase has been debited from the Mi-Sol bank account. The consequence of this is that these increases will have to be paid retrospectively in January 2009.
It has been reported that when an owner tried to pay her bill into Banco Popular with a cheque from her own bank it was refused, she asked the young man behind the counter as to the reason and was told that the Administrator of Mi-Sol had instructed them not to receive payment by cheques from other banks. I made a telephone call to APYME who denied this vehemently. I suggested they make a call to Banco Popular to get an explanation.
Gates.
Mi-Sol have lost their appeal to have the gates re-instated, we are waiting for the relevent paperwork. The cost of a further appeal is 1500 euros with a result not expected for 5 years, needless to say it has been decided not to appeal at this time as the bank balance is at a precarious low. The gardeners are not working this month due to lack of funds, residents have been asked to keep the outside of their plots tidy if possible. It is apparent that the swimming pool contract is a major drain on our resources and it's not likely they will receive payment this month.
After the EGM some drastic actions will need to be taken. Thankyou to all those owners who have promptly paid their bills.

EGM Proxy form
Neill has made it his intention to resign as President of Mi-Sol and has called for an EGM for Saturday 29th November. Many owners came out for the AGM in September and will probably feel agrieved at his decision to call an EGM so soon but in his favour he is inundated with work and his priority must be his family and their well being. I'm sure you will agree with me that his efforts last year have been commendable, we have an excellent pool facility available all year round and thanks to this blog more people have been informed of the comings and goings of Mi-Sol. It was a pity that he inherited debts which resulted in the bank balance fluctuating.
The situation isn't very much better now.
I am Mo Taunton and I have been encouraged to put myself up for President at the forth coming EGM. I have attached a short resume to inform you a little of my experience and also a proxy form if you feel you wish to support me which can be emailed to Neill in the usual way.

Bank Statement
The latest bank statement shows two debits on 22/10 and 24/10 relating to the courts. The Administrator has been informed and will be contacting the lawyer for an explanation.
These transactions have left the balance very low, the electric and water will be debited and so it is imperative that the latest bills be paid promptly.

Resignation
Many of you will be aware of the recent upheaval regarding providers of English television programmes on the Costa Blanca, and in particular the instant demise of one of the major companies. I do not wish to go into the "whys and wherefores" here, suffice to say that this meant I was instantly out of work without warning, losing my business which had taken almost ten years to build.
Fortunately I was soon contracted by another major provider to help them cope with the sudden demand from many thousands of people wishing to receive their favourite television programmes again. However this means that my colleagues and I are working extended hours 7 days a week to cope with the demand. This is likely to continue for the foreseeable future.
Because of this situation I simply do not have the time needed to carry out my responsibilities as President. It is not in the best interests of the Community for me to carry on, therefore I have reluctantly decided to call an Extra Ordinary General Meeting to elect a new President. A copy of the letter asking the Administrators to make the required arrangements is attached. I had wanted to stand down at the recent AGM in September, but due to a decision made at the General meeting in 1981 and entered in Mi Sol Estatutes, was not legally able to do so, this despite a resolution passed at the AGM in September 2007 that the President should be elected for a term of one year.

Erroneous figures on balance sheet
Balance sheets passed around at the AGM caused a stir when it was noticed that the figures in English differed from those in Spanish. APYME was informed on the following Monday and by Tuesday an explanation was forth coming; apparently the fault lay with an inexperienced computer user who had entered the incorrect figures on the Spanish sheet. The English version is the correct one and amended sheets were delivered to the committee meeting of the 14 October.

AGM notes - 27th September
The yearly meeting was held in the Bar in preference to the terrace mainly because of the heavy showers. Paco and his supporters were already insitu and had been since 9.00am. The meeting was well attended, extra seats had to be brought in from outside. Paco and his Spanish supporters left as the meeting got underway but not before distributing a notice in Spanish, which translated into a request from them to the Procuradora de los Tribunales in writing to put forward an appeal against the court judgement found in Pepe's favour earlier in the year. It is our understanding that this judgement was final and no appeals could be made.
The meeting opened with a few words from the President remembering those who have passed on and thoughts for anyone who is suffering from illness. The President also thanked his committee and others who have helped throughout a very difficult year not only financially.
The minutes of last year's AGM were signed as a true copy although I believe not many owners had received a copy. The balance sheet was distributed resulting in several queries, it was stated that owners can go to the office of APYME at any time for explanations. A separate sheet was circulated itemising expenditure.
During the year 30,000 Euros has been paid out in relation to inherited expenses from the previous year as reported in earlier posts this included Social Security, taxes, overdue fees to APYME and others.
The majority of owners wanted the swimming pool functional and this has been achieved albeit at great expense, there is still 12,000 Euros outstanding which is to paid off at 1,500 monthly and a further 500 Euros a month for maintenance. Considering Mi-Sol was paying out 1,000 Euros weekly as a result of water leakage, this fee should be justified.
As reported in an earlier post there has been an increase in the electric and water charges. Inflation stands at 4.9% and it was voted unanimously to increase the Community Fees by 5%. At the moment the bank balance stands at 9,000 Euros and so an appeal was made to all owners to pay their fees if they haven't done so.
Neill Stacey has agreed to stand as President for this year and there have been two changes to the committee; namely the Vice President is now Mr Peter Whitehead and Mrs Mo Taunton has taken over as Secretary, these positions were approved unanimously. The two vocal members, Jackie Braim and Tom Connolley have been made committee members.
